1. Who we are
Berger Lykos Manufaktur (registered in Switzerland; registered office: Zurich) designs and sells high-performance peripherals. You can contact us at info@lykosmanufacture.com.
2. Scope
These terms apply to your use of this site and to all orders placed directly with LYKOS. By ordering, joining a waitlist, or using this site you accept these terms.
3. Orders, pricing & payment
- Orders are subject to availability; we may refuse or cancel before dispatch with a refund.
- Prices are shown in the indicated currency. Swiss VAT is included where applicable; other taxes/duties are not.
- Import duties, local taxes, and brokerage fees are borne by the recipient.
- Payment is taken at checkout via our payment provider (Stripe). Your card is charged when you place the order.
- Pre-orders / waitlist offers may have indicative timelines and can shift due to production or logistics.
4. Shipping & risk transfer
- We ship to the delivery address you provide. You are responsible for accurate information.
- Risk and title transfer on delivery to you or your designated carrier/agent.
- Shipping windows are estimates; delays may occur due to customs, carriers, or force majeure.
5. Withdrawal, returns & exchanges
- Swiss law does not mandate a general right of withdrawal for distance sales. We do not offer returns for change-of-mind unless expressly stated in the product offer.
- If your product is defective or damaged on arrival, contact us within 14 days with proof (photos/description). We will guide you through repair, replacement, or refund as appropriate.
- Customized products (e.g., engravings or special finishes) are not returnable unless defective.
6. Warranty (Gewährleistung)
Statutory Swiss warranty rights apply (Swiss Code of Obligations, art. 197 ff.). Our products are warranted against defects in materials and workmanship for two years from delivery. This does not cover normal wear, misuse, unauthorised modifications, or accidental damage.
Remedies are, at our discretion: repair, replacement, or refund. Please notify defects promptly with documentation.
7. Limitation of liability
To the extent permitted by Swiss law, we exclude liability for indirect or consequential damages (e.g., loss of data, revenue, or business). Our total liability for a claim is limited to the amount you paid for the product giving rise to the claim, except for liability that cannot be limited under Swiss law (e.g., intent, gross negligence, personal injury).
8. Intellectual property
All content, designs, marks, and product imagery remain the property of LYKOS or its licensors. You may not reproduce or use them without our prior written consent.
9. Data protection
Our processing of personal data follows Swiss FADP and, where applicable, GDPR. See our Privacy Policy for details on data use, rights, and contacts.
10. Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, war, strikes, power outages, network or supply disruptions).
11. Governing law & venue
These terms are governed by Swiss substantive law (excluding conflict-of-law rules and the UN CISG). The courts of Zürich, Switzerland have exclusive jurisdiction, subject to any mandatory consumer forum rights that cannot be waived.
